Recent statements by Colombia’s new President, Abelardo de la Espriella, announcing the launch of enforcement operations aimed at identifying foreign nationals who are in Colombia with an irregular immigration status, have once again brought attention to an issue of particular importance for those who live, work, study, or temporarily stay in the country: maintaining a regular immigration status.

Although expressions such as “illegal immigrant” are frequently used in public debate, from a legal perspective it is more appropriate to refer to foreign nationals with an irregular immigration status. Irregular status is an administrative situation that may arise, among other circumstances, when a person remains in Colombia beyond the period authorized for their stay or when the visa that allowed them to remain in the country expires.

Recent Announcements Make It Particularly Important to Review Your Immigration Status

On August 24, 2026, the Colombian Government announced the launch of coordinated enforcement operations by Migración Colombia and the Colombian National Police to identify foreign nationals who are irregularly present in Colombian territory. According to publicly reported statements, the authorities will prioritize foreign nationals involved in criminal activities, but immigration controls will also extend to those who have not regularized their stay in the country.

Regardless of the political considerations surrounding these announcements, there is a practical takeaway for any foreign national currently in Colombia: this is a good time to verify your immigration status and, if there is any irregularity, take appropriate steps to resolve it promptly.

What Happens If I Have Already Exceeded My Authorized Period of Stay?

Exceeding the authorized period of stay does not mean that a person should simply remain in an irregular immigration situation or wait until the time comes to leave the country.

Colombian law provides administrative procedures for addressing these situations. Depending on the particular circumstances, the foreign national may need to appear before Migración Colombia, explain the circumstances, complete the applicable administrative procedure, and pay the corresponding fine.

An irregular stay may result in an immigration sanction, the nature and amount of which will depend on the circumstances of each case. For this reason, there is no single solution applicable to every foreign national who has overstayed their authorized period.

The important point is to understand that simply allowing time to pass will generally not solve the problem; in fact, it may make it worse.

Regularizing Your Status Does Not Simply Mean Paying a Fine

This is particularly important. Payment of a monetary sanction does not necessarily resolve a person’s immigration status by itself.

It is necessary to determine what steps should be taken after the administrative sanction procedure: whether the person should obtain a salvoconducto (temporary safe-conduct permit), leave the country, apply for a visa, or complete another immigration procedure. Therefore, before taking any action, it is advisable to conduct a comprehensive assessment of the individual case.

It is also important to avoid improvised solutions. Attempting to leave Colombia after overstaying an authorized period, appearing before the immigration authorities without first understanding the status recorded in the immigration system, or filing a visa application without having resolved a prior immigration irregularity may create additional difficulties.

If Your Immigration Status Is Irregular, Now Is the Time to Review It

Recent Government statements indicate that greater emphasis will be placed on immigration enforcement and controls. For foreign nationals who are lawfully present in Colombia, this simply reinforces the importance of keeping their immigration documents valid and complying with the terms and conditions of their visa or permit.

For those who have already exceeded their authorized period of stay, whose permits have expired, who have inconsistencies in their immigration records, or who know that they are currently in an irregular immigration situation, our recommendation is different: do not wait for the situation to be detected during an immigration enforcement operation.

It is preferable to review your immigration history, determine the applicable procedure, and properly appear before Migración Colombia to seek to regularize your status, comply with any sanctions that may legally apply, and determine the appropriate mechanism to either continue residing legally in Colombia or leave the country in compliance with Colombian immigration requirements.

In immigration matters, prevention remains the best strategy: if you know that your authorized stay has expired, seek professional advice and take steps to regularize your status before the immigration authorities require you to do so. At DEC Consultores, we can assist you throughout this process.
